Right of withdrawal

In accordance with § 312d para. 4 no. 6 BGB, there is no right of withdrawal for the delivery of goods whose price is subject to fluctuations on the financial market over which the entrepreneur (seller) has no influence. This also includes precious metals (coins and bars) which are purchased for capital purposes due to their precious metal content.

A right of return is hereby expressly excluded.

General Terms and Conditions Sculptures

Procedure and order

BUGOLDI produces personalized sculptures by hand from 999.9% fine gold. BUGOLDI displays models and samples on the website. On request, the client receives an individualized offer, which is based, among other things, on the complexity, current gold price and packaging. The client can express their wishes regarding the model or coin, such as size, weight, motif or relief. Customized 3D scans, drawings, photos or videos can also serve as a template. By paying the offer, the customer accepts BUGOLDI’s offer, automatically accepts the GTC and commissions BUGOLDI to manufacture and deliver the product.

Sculptures

All models and specifications shown on the website are samples and examples and may differ in color, surface, shape or dimensions in reality. The material is exclusively 999.9% fine gold, unless otherwise agreed individually.

Delivery and delivery time

Worldwide free delivery is insured and is carried out by an authorized representative or by a transport company commissioned by BUGOLDI. The production and delivery time is stated in the offer. Compensation for damages due to delayed delivery for reasons beyond BUGOLDI’s control is excluded.

Weight

The weight of the delivered sculpture may deviate from the order due to the manufacturing process. Deviations exceeding a tolerance of 1.5% of the agreed weight will be reimbursed by BUGOLDI after delivery. The basis for calculating the credit note is the gold price (100g bar) on the day of payment of the purchase price.

Terms and conditions

The prices displayed on the BUGOLDI website may change if, for example, the price of gold changes. The final prices are shown in the individual offer. Due to the fluctuating price of gold, an offer is only valid for 10 days after delivery and is deemed to have been accepted if the offer price is paid in full within this period.

24 carat fine gold

BUGOLDI manufactures all sculptures and coins from 999.9 fine gold, which is sourced from certified refineries in Germany. BUGOLDI sculptures and coins are stamped with 999 fine gold by our experienced master goldsmiths.

Payment

BUGOLDI only accepts full payment by bank transfer or in cash after the order has been placed.

Right of withdrawal

A right of revocation is excluded, as all BUGOLDI sculptures and coins are personalized unique pieces and are only made individually by hand according to the order and specifications of the customer and are provided with his signature and the date.

Money laundering, jurisdiction

BUGOLDI complies with all current national legal regulations and requirements, in particular with regard to money laundering. BUGOLDI shall not be liable for any additional costs incurred, e.g. customs duties or taxes.

In principle, BUGOLDI attaches great importance to customer satisfaction and fulfills orders properly, as agreed and on time. Should disputes nevertheless arise and out-of-court settlement attempts prove unsuccessful, German law shall apply. The place of jurisdiction is Hamburg.

Scope of application for coins and bars

The following terms and conditions apply to all business

between Bugoldi Inh. Michael Steudte (seller) and the consumer (buyer), unless other conditions have been agreed in writing.

The terms and conditions become part of the contract and apply to deliveries and services, as well as to all offers made by us in legal transactions with consumers.

Any deviating terms and conditions of business of buyers are hereby expressly rejected.

Consumers within the meaning of these terms and conditions are natural persons who conclude a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity (see § 13 BGB).

Offer and conclusion of contract

Our offers are subject to change and non-binding.

Contracts are only concluded when you place an order (in writing or by telephone) and we dispatch or deliver the ordered goods.

Prices

All offers are subject to change.

If an item is no longer available, the buyer will be informed immediately.

The prices valid on the day the contract is concluded and confirmed in writing by the seller shall be deemed to have been agreed in euros plus the respective statutory VAT.

Postage and shipping costs will be charged separately (see shipping costs).

Cancellation policy

Right of withdrawal

In accordance with § 312g para. 2 no. 8 BGB, there is no right of withdrawal for the delivery of goods whose price is subject to fluctuations on the financial market over which the entrepreneur (seller) has no influence. This also includes precious metals (coins and bars) which are purchased for capital purposes due to their precious metal content.

We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board and are generally not prepared to do so.

Delivery, delivery time and transfer of risk

The ordered goods will be dispatched within 15 working days of receipt of payment in our account.

If the customer is a consumer, the risk of loss, destruction or accidental deterioration of the purchased goods is only transferred to the buyer when the goods are dispatched.

If the buyer is in default of acceptance, this shall be deemed equivalent to handover.

Terms of payment, default, counterclaims

All invoice amounts (purchase prices and fees for ancillary services) are due in advance (prepayment) immediately after receipt of the invoice, at the latest after 3 value dates, without deductions, unless otherwise agreed in writing.

If the deadline of 3 value dates is exceeded, the buyer shall be in default of payment without a reminder. The buyer shall bear the default interest for the invoice amount due at a rate of 5% above the base interest rate of the Deutsche Bundesbank. We reserve the right to prior sale for orders that are not paid within 10 days of the order date. We are then no longer obliged to deliver.

Payments can be made in cash or by bank transfer.

Payments shall only be deemed to have been made when we can dispose of the invoice amount in our bank account without loss.

The exercise of a right of retention against the payment by the buyer is excluded, insofar as the right of retention is not based on the same contractual relationship.

The Buyer shall only be entitled to a right of set-off in the event that a counterclaim has been legally established, is undisputed or has been recognized by us.

Retention of title

The delivered goods shall remain our property until full payment of the invoice amount and all existing claims arising from the business relationship with the purchaser.

The buyer must inform us immediately of any access by third parties to the delivered goods, for example in the event of seizure, as well as other damage, destruction or a change of ownership.

In the event of breach of contract by the purchaser, in particular in the event of default in payment or a breach of one of the aforementioned obligations, we shall be entitled to withdraw from the contract and demand the return of the delivered goods.

Warranty

In the event of an identified defect, the buyer shall initially have the choice of whether subsequent performance is to be effected by replacement delivery or repair. However, we are entitled to refuse the type of subsequent performance chosen if it is only possible at disproportionate cost and another type of subsequent performance would not cause significant disadvantages for the buyer.

If the supplementary performance fails, the contractual partner (buyer) may – without prejudice to further claims for damages – withdraw from the contract or reduce the remuneration. In the case of minor defects, however, the buyer shall not be entitled to withdraw from the contract.

If the contractual partner (buyer) withdraws from the contract after subsequent performance has failed, he shall not be entitled to any additional claims for damages due to the defect.

Limitation of liability

Claims for damages as well as claims arising from expenses incurred by the consumer (buyer), regardless of the legal grounds, in particular due to delayed delivery, breach of duty or unauthorized actions, are excluded. This shall not apply in the event of gross negligence or intent on the part of the seller.

Claims for damages by the customer arising from injury to his life, body or health, which are based on a culpable breach of duty on our part, as well as claims by the consumer (buyer) under the Product Liability Act, remain unaffected.

 

Compensation for cancellation B2B

For commercial buyers, an order for coins and bars is binding and cancellation by the buyer is not possible.
Excepted from this are delivery delays of more than eight weeks from the order date, which are due to BUGOLDI’s fault. In the case of advance payments, the date of receipt of payment counts as the order date.
If the buyer nevertheless cancels the purchase contract, the seller is entitled to compensation of 10% of the order volume. BUGOLDI is entitled to offset claims against advance payments made.
BUGOLDI defines commercial buyers as customers who deviate from the average private customer volume in terms of order quantity, amount or repetitions. It is irrelevant how the order was placed (website, by phone, advertisements, verbally).

Pricing website

All prices stated on BUGOLDI are for guidance purposes and are not binding. BUGOLDI always creates a final offer at the current daily gold price before the purchase and immediately before payment. BUGOLDI is bound to this individual offer for 2 working days.
